Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Itinera mobile application ("App") and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

Itinera is an AI-powered travel companion that helps users plan trips through conversational AI, generate itineraries, manage travel plans, and optionally import booking confirmations from email. The Service is provided on an "as is" and "as available" basis.

3. User Accounts

To use the Service, you must create an account. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful or unauthorized purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or its infrastructure
• Use automated tools to scrape or extract data from the Service
• Upload malicious content or attempt to compromise the Service

5. AI-Generated Content

The Service uses artificial intelligence to generate travel recommendations and itineraries. Please note:

• AI-generated content is for informational purposes only and may not always be accurate or up-to-date.
• AI-generated itineraries, recommendations, and travel advice may contain errors, including but not limited to: incorrect business hours, outdated pricing, closed or relocated establishments, inaccurate travel times, and safety information that does not reflect current conditions.
• You are solely responsible for verifying all travel-related information before making bookings, reservations, or travel decisions.
• We do not guarantee the availability, pricing, or quality of any recommended places, restaurants, or activities.
• Itinera is not a licensed travel agent, tour operator, or travel advisory service, and does not make bookings on your behalf.
• We are not liable for any losses, injuries, or damages arising from reliance on AI-generated content, including but not limited to missed flights, unsuitable accommodations, or unsafe travel conditions.

Your chat messages and trip-related inputs are processed by third-party AI providers (including Anthropic and OpenAI) to generate responses. For more information, see our Privacy Policy.

6. Gmail Integration

If you choose to link your Gmail account to import booking confirmations:

• You authorize Itinera to access your Gmail in read-only mode for the sole purpose of identifying travel booking emails.
• You can revoke this access at any time through the App or your Google Account settings.
• Our use of Gmail data is governed by our Privacy Policy and complies with the Google API Services User Data Policy, including the Limited Use requirements.

7. Subscriptions and Payments

Some features of the Service may require a paid subscription. Subscription terms, pricing, and billing are managed through the applicable app store (Apple App Store or Google Play Store) and processed by RevenueCat. Refunds are subject to the respective app store's refund policy. You may manage or cancel your subscription through your app store account settings.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Itinera and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of any content you create through the Service (e.g., custom trip notes).

9. Limitation of Liability

To the maximum extent permitted by law, Itinera shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service, including but not limited to travel disruptions, inaccurate recommendations, missed bookings, personal injury, property damage, or data loss. Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Itinera and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately. Sections 5, 8, 9, 10, and 13 shall survive termination.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes through the App or via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in King County, Washington, and you consent to personal jurisdiction and venue therein.
